After Carly Smithson's new band Evanescence With an Uglier Lead Singer, we mean The Fallen, was hit with a cease and desist letter, they quietly changed their name to We Are The Fallen. The band quickly updated its MySpace, home page, and other sites that we clearly saw the band listed as The Fallen on. But now Carly insists on her Twitter that this wasn't the case.
Just to clear up for @LauraVazz the band name is "We are the Fallen". Always was and never changed EVER! (dont believe everything you read)
The media keeps saying "The Fallen" not us . "We are the Fallen" was always our website URL weeks before our press conference .
The band did indeed have the name wearethefallen.com, but the site listed the band as "The Fallen". Why did they pick that name? Because thefallen.com was already taken.

Carly Smithson, the official fail whale of VFTW, can add another failure to her resume. Just a few days ago, Carly and former members of the band Evanescence announced that they had formed a new band called The Fallen. Turns out that the unoriginal name was already taken by a semi-successful band in Pennsylvania and they're sending a cease and desist letter to Carly's group. They might as well rename themselves The Failen at this point. Their official MySpace seems to have already renamed the band We Are the Fallen.
Also, the free single that Band With The Changing Name tried to promote didn't get out to their fans on time and the band was forced to create a video to apologize. Carly blames the "overwhelming response" but we all know the band probably has no idea what they're doing and their site crashed. Carly claims that it wasn't a site crash, but why would she bring that up if that wasn't the case?
Double Epic Failure Moment!
Unaffected by failing at having a career five times, Carly Smithson is now in a band with the former Evanescence members (minus Amy Lee). Their first song "Bury Me Alive" is out now, and the song is trying WAY too hard to make Carlyplant sound like Amy Lee. It's amusing. And the song is not catchy. Looks like another failure is in the works.

Instead, the band is going to tour for a year and a half and record a few songs to release online during that time. So what ever happened to Carly's new record deal she kept bragging about that we all knew didn't exist? Apparently she could just drop it all of a sudden to join a band? Caught in another lie, that's Carly's fifth career failure. Let's go for six!
Someone e-mailed us this video of Carly Smithson, the official Fail Whale of VFTW (pun intended), performing "Let Me Fall" from her upcoming album. She sounds absolutely horrific. Even though we hated her on Idol, she had one or two good moments. This is just pure crap. She's on her way to her fifth failure of a career. When will she learn that no one wants to hear her sing? Anyone want to let her fall... off a cliff?
So while we still haven't brought you a single update about Carly Smithson's career post-Idol (because there hasn't been one since no one wants her to make music), we do have an update from TMZ that is pretty funny. So what does Carly do nowadays? Well she's now moonlighting as Kimberly Caldwell's personal butt cleaner. Oh, Carly. The saddest part is that you're now at the level of desperation of Kim Caldwell since you elect to hang out with her. That's even worse than you were before. Carly is about to get things going as Amy Lee's replacement in Evanescence and if she thinks VFTW has given her a hard time, wait till she meets the long-time Evanescence fans, like the person who made this video. Hey Carly, you may want to leave your Spanx at home as you may have to run really fast from your concerts.
